For Legal DNA Testing, there are some additional steps required during the sample collection process, to ensure a chain of custody is maintained so the results can be legally admissible. We have prepared the below checklist to help simplify the process. Comprehensive instructions will also be included with your DNA Kit.

Everything else needed for the collection, such as paperwork, the mouth swabs and return postage envelope, will be included in the kit.
No. You must ensure that you do not eat or drink anything, or smoke/vape for at least 30 minutes before your collection. For small children, this includes no formula or breast milk for at least 30 minutes prior to collection.
We also strongly recommend clients brush their teeth at least 30 minutes prior to the collection, and then rinse their mouth thoroughly with water.
You can still drink water up until the time of collection. In fact, this is preferable as a dry mouth can make it difficult to obtain a sample.
Drinking, eating and smoking can cause contamination of the sample. If the sample is contaminated by food and drink particles, we will be unable to obtain a result from the sample and will require a recollection at an additional charge.
For a Legal DNA Test, the samples must be collected by a third-party, such as a doctor or pathology nurse. We always recommend that clients first approach their local doctor or GP to see if they are willing to assist with the sample collection process. Alternatively, you can also approach your local pathology collection centre. Click here to find a pathology centre near you.
DNAQ offers the convenience of in-house collections at our laboratory in Brisbane, for an additional fee of $75 per person for legal cases. We can arrange for Justice of the Peace to be present, and collect your samples at one appointment.
Yes. Any registered, on-duty doctor or pathology collector can collect the samples for you should they feel comfortable doing so.. There is no special training or qualification required to collect the samples for a Legal Paternity Test. All that will be required of the collector is to collect the mouth swabs, complete the paperwork with their details and arrange for the samples to be posted back to our laboratory in the supplied return postage envelope.
They are not required to complete any testing, all testing of samples is completed in DNAQ’s laboratory.
Many organisations make JPs available at scheduled times and locations. This may include your local shopping centre, council, court, library, chemist, post office or police station.
For assistance in finding a JP near you, please refer to your state’s JP Register below. The register lists a JP’s location, availability and telephone number. Please note that JPs are volunteers and may not be available at all times.
It is preferable that Form 2 is witnessed by a registered Justice of the Peace or Police Officer. However, if you are unable to locate a JP, please see the Australian Government’s List of Authorised Witnesses.
No. If you are attending separate collections, you will only need to fill in your details. The sections for the other parties can be left blank, or you can put a line through the empty boxes. The other parties will complete their own paperwork at their collection.
Anyone aged over the age of 18 (including adult children) must complete and sign a Form 2 and Authority to Undertake Legal DNA testing consent form. Both of these forms will be included with the DNA Kit DNAQ sends to you.
For parties under the age of 18, Form and and the Authority form must be completed and signed by their legal guardian.
